OUR RIGHTS We reserve the right to: modify or withdraw, temporarily or permanently, the Website, or any part thereof, with or without notice to you and you confirm that we shall not be liable to you, or to any third party, for any modification or withdrawal of the site; and/or change these Conditions from time to time, and your continues use of the Website, or any party thereof, following such change, shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately refrain from using this website. we will use our reasonable endeavours to maintain the website. The website is subject to change from time to time. You will not be eligible for any compensation because you cannot use any part of the website or because of a failure, suspension or withdrawal of all or any part of the website due to circumstances beyond our control.
The E-commerce Terms and Conditions will be exclusively governed by and construed in accordance with the laws of the Republic of South Africa, whose courts will have exclusive jurisdiction in the event of any dispute arising, subject to the proviso that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.
In view of the extensive range of products sold by us, it is not practical to publish detailed specifications of our products. All images, descriptive matter, specifications and advertising on our site are provided for the sole purpose of giving an approximate description of the goods. Goods should be bought for the correct application, weight and rider skill / age requirement. All Credit Card payments shall require the signature of the cardholder upon collection of the goods or else the goods shall not be released. We shall only allow the cardholder to collect of which positive ID is required (RSA Identity document or Passport – NO DRIVERS LICENCE). All fraudulent attempts shall be handed over to our private investigating unit. Once an order has been placed, your order shall remain pending until stock availability has been confirmed. If the item is in stock, you may expect to collect your order within 5 (FIVE) working days. For cancellation of orders once payment has been made WITHIN 5 (FIVE) days, a handling fee of R 500.00 per unit will be charged upon refund.
Strictly as per agreed terms. Interest will be charged at 2% above overdraft rate on overdue accounts. Legal ownership of the goods will be passed to the purchaser once the purchase price as invoice has been paid in full. Should any of the selected items not be available, you must allow 20 (TWENTY) working days for collection, including freight transit time, as required. All orders placed on weekends and public holidays shall only be processed on the following working day. Should collection of any selected items not take place, due to any fault of our own, we will not charge you for the specific items, and will refund any money already paid in full for the specific items unavailable. Should non-collection be due to your fault, such as unable to collect your purchase, you will be liable for the above cancellation charge of R 500.00 and an additional charge of R 250.00 shall be deducted from your payment. In the event of your placing an order for an incorrect or inappropriate product, do not accept collection from the dealer. The correct item will be sent within the above time period and any difference in price is payable or refunded. In such instances, we charge handling fee of R 300.00 on the price of the incorrectly ordered goods. Take notice that risk shall pass to you once the goods have left the dealers premises. You are required to activate your warranty in order to receive 1 year limited Big Boy warranty and that all service intervals must be strictly adhered too and updated on the Big Boy website. www.bigboyscooters.co.za
Once collected from the Big Boy Dealer, YOU CANNOT RETURN FOR ANY ITEM FOR A REFUND. Should you arrive at the dealer and not be satisfied with your purchase, you may cancel your order. The standard cancellation charge will be charged upon refund. Should any selected item be damaged before acceptance from the Big Boy dealer (discretion of the Big Boy dealer), only the specific item may be exchanged or refunded in full.
